the committee chair On that point, did HCD or the court provide any guidance in terms of what would have been sufficient?
a speaker No.
city staff It was just that what was stated on the record did not appear to substantiate a denial.
the committee chair But no
city staff standard,
the committee chair no guidance what still what may have it's one of those.
the committee chair We know it when we see it?
city staff Correct.
city staff Actually, in our research of cases and we searched high and low for examples.
city staff And as you can see, all these examples are ones where the court said you have to approve it or HCD said you had to approve it.
city staff And the reason why all the examples say this is because we could not find an example where HCD agreed that the concession should not be approved or that a judge agreed that the concession could be denied.
